Kick Cycle - Terms and Conditions

1. Acceptance of Terms

Welcome to Kick Cycle. By accessing or using the Kick Cycle mobile application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Kick Cycle is a sneaker collection management application that allows users to:

  • Track and organize their sneaker collections ("Kicks")
  • Manage closets (collections of sneakers)
  • Search for sneaker products via StockX integration
  • Track rest days for sneakers
  • View collection statistics and details

3. User Accounts

3.1 Account Creation

You must create an account to use certain features of the App. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access to your account

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.1 Your Data

You retain ownership of all data you submit to the App, including:

  • Sneaker information (names, brands, purchase dates, images)
  • Closet names and descriptions
  • Personal collection data

4.2 Data Storage

Your data is stored securely using Firebase services. By using the App, you consent to the storage and processing of your data as described in our Privacy Policy.

4.3 User Conduct

You agree not to:

  • Upload false, misleading, or fraudulent information
  • Use the App for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the App's functionality

5. Third-Party Services

5.1 StockX Integration

The App integrates with StockX for product search functionality. We are not affiliated with, endorsed by, or sponsored by StockX. StockX product data is provided "as is" and we make no guarantees about its accuracy or availability.

5.2 Firebase Services

The App uses Firebase for authentication and data storage. Your use of Firebase services is subject to Google's Terms of Service and Privacy Policy.

6. Intellectual Property

6.1 App Ownership

The App, including its design, features, code, and content (excluding user-generated content), is owned by Kick Cycle and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Disclaimers

7.1 No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 Data Accuracy

We do not guarantee the accuracy, completeness, or reliability of any content or data displayed in the App, including StockX product information.

7.3 Service Availability

We do not guarantee that the App will be available at all times or that it will be error-free. We reserve the right to modify, suspend, or discontinue the App at any time without notice.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KICK CYCLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Indemnification

You agree to indemnify and hold harmless Kick Cycle and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party

10. Updates and Modifications

10.1 App Updates

We may release updates to the App from time to time, including over-the-air updates via Shorebird. You agree to accept such updates to continue using the App.

10.2 Terms Updates

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms.

11. Termination

We reserve the right to terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users, us, or third parties
  • Violates applicable law

Upon termination, your right to use the App will immediately cease.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and Kick Cycle regarding the use of the App and supersede any prior agreements.
